Second DUI in North Dakota?
Now the penalties have teeth.
A second DUI within seven years carries mandatory jail, a year or more without a license, and 360 days on the 24/7 sobriety program. This is the point where a lawyer who does DUI every day changes the outcome.

What a second-offense DUI carries
A second DUI within 7 years of the first is still a Class B misdemeanor, but the mandatory minimums jump sharply:
| Penalty | Second offense in 7 years |
|---|---|
| Classification | Class B misdemeanor |
| Minimum jail | 10 days |
| Minimum fine | $1,500 |
| 24/7 sobriety program | 360 days |
| License suspension | 365 days (BAC under .18) / 2 years (.18 or higher) |
| Addiction evaluation | Required |
Does the first one count?
The 7-year lookback runs from offense date to offense date. A prior conviction from another state usually counts if that state’s law is equivalent. A prior that was reduced to reckless driving generally does not count as a prior DUI. Before anything else, we verify whether the state can actually prove the prior — it’s not automatic.
How we approach a second offense
The defenses are the same as on a first offense — the stop, the field tests, the machine, the advisory — but the stakes justify running every one of them to ground. Two things get extra attention:
- The prior. If the earlier case has a defect (no lawyer, no valid plea colloquy, wrong dates, an out-of-state statute that isn’t equivalent), the “second” offense may have to be charged as a first.
- Sentencing structure. Where a conviction is unavoidable, how the jail time is served (weekends, house arrest, work release), when the 24/7 program starts, and how the license suspension is sequenced can be negotiated. A plan that keeps you employed is a win.
Your license
A second-offense suspension is a year minimum. A temporary restricted license is still possible on a repeat offense, but you must be enrolled in the 24/7 sobriety program first. The DOT hearing — requested within 10 days of your Report and Notice — is the only forum to challenge the suspension itself. How the DOT hearing works.

Is the 10 days of jail really mandatory?
Yes. The statute sets 10 days as a minimum for a second offense in 7 years. The judge has no discretion to go below it on a DUI conviction, which is why the fight is usually over whether it’s a DUI conviction at all, or a second one.
My first DUI was 8 years ago. Is this a second offense?
For the mandatory-minimum enhancement, no — the lookback is 7 years. The prior can still be considered by the judge and prosecutor, but the mandatory penalties are first-offense penalties.
Can I keep driving for work?
Possibly. On a repeat offense you can apply for a temporary restricted license, but only after you’re enrolled in the 24/7 sobriety program. Call and we’ll walk through the specifics of your record.
