Your license is on a separate clock
After a North Dakota DUI arrest, the DOT license suspension is handled separately from your criminal case — and you have only 10 days from the date on your Report and Notice to request an administrative hearing. Miss it and the suspension takes effect automatically, no matter what happens in court.
What happens when you call
You talk to a lawyer
Not a call center. You’ll explain what happened and get straight answers about the charge, the likely penalties, and your options.
We protect your license
We request the DOT hearing on your behalf and start pulling the evidence — the stop, the field sobriety tests, the breath or blood test, the paperwork.
We build the defense
Was the stop legal? Was the test done right? Was the machine calibrated? Most DUI cases are won or lost on the details, and we look at all of them.
Why people call Schwab, Thompson & Frisk
We do this every day
Many firms take the occasional DUI. We handle several hundred a year, so we know the officers, the prosecutors, the judges, and the arguments that work in each courthouse.
First offense or fourth
There’s no such thing as “just” a DUI — a first offense can still mean jail time, a suspended license, and years of higher insurance. And the stakes climb fast with each prior.
Refusals, too
Refusing the breath test is its own crime in North Dakota. If you refused, you need a lawyer who understands both the criminal charge and the automatic license consequences.

Questions people ask us at 2 a.m.
Will I lose my license?
Possibly, but not automatically — and not without a fight. The DOT suspension is separate from the criminal case and can be challenged at an administrative hearing, but only if it’s requested within 10 days. That’s usually the first thing we do.
Is a first DUI a big deal?
Yes. In North Dakota a first offense is a criminal misdemeanor that can carry a fine, possible jail time, a license suspension, and a conviction on your record that follows you for years. It’s worth defending properly.
I refused the breath test. Is that better or worse?
Refusal is a separate offense with its own license consequences, so it’s not the loophole people hope it is. But refusal cases have their own defenses. Call us and we’ll walk through it.
What does a DUI lawyer cost?
The consultation is free. If you hire us, we’ll quote a flat fee up front so there are no surprises. Compare that to the cost of a conviction: fines, higher insurance for years, and possibly your job.
Can you help if I was arrested outside Fargo or Bismarck?
Yes. We represent clients in every county in North Dakota — Minot, Grand Forks, Williston, Dickinson, Jamestown, and everywhere in between.
